Current status and authority
Brazil built its federal fixed-odds framework on Law 13,756 and Law 14,790 of 29 December 2023. The Secretariat of Prizes and Bets of the Ministry of Finance (SPA/MF) is the administrative authority for authorisation, supervision and sanctions. Law 14,790 requires assessment of documentation, technical and financial capacity and the reputation of controllers and managers, and makes authorisation conditional on payment of a fee.
The SPA’s legislation page nonetheless lists Provisional Measure 1,394 of 25 September 2026. According to the official description, it prohibits the operation, offer, intermediation and advertising of fixed-odds betting lotteries in the national territory, creates an inter-institutional committee against illegal offers and advertising, and amends Law 14,790. Because it is provisional, its validity, conversion into law or lapse must be followed. The “restrictive change” label reflects that situation, not a final conclusion on every dispute or transitional effect.
Authorisation, cost and scope
Law 14,790 provided that authorisation would be granted only after legal and regulatory requirements were verified. The fixed fee could reach R$30 million and cover up to three brands per authorisation act. Later SPA rules developed application requirements, a transition period, technical systems, integrity, advertising, anti-money-laundering and responsible-gambling duties.
The September 2026 measure changes the operational starting point. A company can no longer rely on the 2023 law or a historical authorisation: it must check the current text of the measure, its implementing acts, SPA communications and any decision affecting licences already issued. An earlier register entry or news story does not by itself show that a given offer may remain available.
Crypto assets and payment methods
Federal gambling regulation is not a general authorisation to accept BTC, ETH or stablecoins. Payment, identification and anti-money-laundering duties must be read together with SPA rules, the financial framework and the rules for virtual-asset service providers. A digital asset can act as an investment, a transfer medium or a settlement instrument; treatment changes with its function.
Our editorial reading is conservative: no operator should advertise “legal crypto betting in Brazil” on the basis of Law 14,790 alone. It must identify the rule that authorises the product, the payment method and the relationship with local providers. After Provisional Measure 1,394, the first question is no longer how to accept crypto, but whether the underlying activity may be offered and under what transition.
What a user should check
A person should verify the domain, the operating entity, the status of its authorisation and the complaint channels in SPA sources. Be wary of a brand that cites a foreign licence in place of Brazilian authorisation, promises returns or pushes deposits in an irreversible asset. Blockchain traceability does not guarantee recovery or remove contractual risk.
If you hold a balance or have a complaint during a regulatory change, keep the terms, receipts, transaction IDs and communications. The aim is not to publish personal data on social media but to keep orderly evidence for the operator, the authority or an adviser. This profile does not recommend platforms or determine the validity of an individual contract.
Editorial position and signals to watch
A broad ban can displace demand to services with no local presence, reduce visibility and complicate protection. It may also respond to real failures of the earlier regime. A serious assessment needs data on channelling, complaints, advertising, indebtedness, fraud, revenue and compliance capacity, not only the number of blocked domains.
We recommend that any permanent change publish an impact assessment, a transition for balances and complaints, enforcement criteria and periodic review. We will follow the provisional measure’s passage, SPA acts and official communications. Until then the status is shown as a restrictive transition, not an open market.
Watch list
Monitoring should cover the National Congress, the formal validity of the provisional measure, implementing rules, authorisation lists and court decisions. Any one of these signals can change the classification. Keeping them separate avoids stating that a proposal is already permanent law, or that a historical authorisation remains intact without checking its current conditions. It also lets us record what changed, when and why the radar label was revised.
